1. What is prohibited
You may not list, sell or ship any of the following. The list is a guide, not exhaustive, and we may add to it at any time.

| Anything unlawful | Any item whose sale, possession or distribution is prohibited or restricted by South African law or regulation. |
| Stolen goods | Any item the seller does not own or is not authorised to sell. |
| Counterfeit and grey goods | Counterfeit items, replicas, unauthorised copies, factory rejects and parallel or grey imports. A seller may not add a disclaimer that they are unsure of authenticity. |
| Weapons | Firearms, ammunition, airguns, imitation firearms, pepper spray, tasers, and military or tactical items. Dangerous or concealed knives, including throwing knives, disguised blades and survival weapons. |
| Explosives and dangerous goods | Explosives, fireworks, flammable liquids, aerosols, pressurised containers, toxic or corrosive substances, and other carrier-restricted dangerous goods. |
| Drugs | Illegal drugs and drug paraphernalia. |
| Medicines and medical devices | Prescription medicines, scheduled substances and regulated medical devices. (Sealed, in-date, non-prescription health-and-beauty is allowed under section 4.) |
| Tobacco and nicotine | Cigarettes, tobacco, vapes, nicotine products and smoking paraphernalia. |
| Alcohol | Liquor may not be sold without the licence the law requires; unlicensed alcohol sales are prohibited. |

| Adult material | Pornography, sexually explicit material and nudity. |
| Recalled or unsafe goods | Recalled products, expired goods, and goods that are unsafe or improperly stored. |
| Intangibles | Digital goods, downloads, e-books, vouchers, gift cards and other non-tangible items. |
| Drop-shipping | Items not physically in the seller's possession, and drop-shipped goods. |
| Hateful and harmful content | Items or listings promoting hate speech, violence, extremism or terrorism, self-harm, or the sexual exploitation of any person. Content that sexualises or endangers children is reported to the authorities. |
| Second-hand restricted goods | Second-hand categories that carry dealer obligations under the Second-Hand Goods Act, where the seller does not meet those obligations. |
2. South African law behind this list
The main statutes engaged include the Firearms Control Act, the Medicines and Related Substances Act (and SAHPRA rules), the Liquor Act and provincial liquor legislation, the Second-Hand Goods Act, the Counterfeit Goods Act, CITES and the National Environmental Management: Biodiversity Act, the Consumer Protection Act (product safety and recalls), and the Films and Publications Act.
3. How we enforce this
3.1 We may remove any listing that breaches this Policy and may report unlawful listings to the authorities or the rights holder. If we receive a complaint, we may suspend the listing or the account while we investigate.
3.2 If we find a seller knowingly listed a prohibited item, we may remove the listing, cancel related transactions, suspend or close the account, and report the matter. A seller has no right to the return of a prohibited item that has been removed or seized, and a seller who lists counterfeit goods may face civil or criminal action by the rights holder, for which SWIPSWXP is not responsible.
3.3 Orders for prohibited items are not covered by buyer or seller protection, and the standard refund and return processes may not apply to them.
4. Allowed with conditions: food and health-and-beauty
4.1 Unlike some marketplaces, SWIPSWXP allows food and health-and-beauty as curated categories. They are not prohibited, but they carry extra rules because of the safety risk.
4.2 Food listings must be from vetted sellers and must be safe, correctly described and, for perishables, handled and collected promptly. Health-and-beauty items must be sealed and in date where the product requires it, with at least 3 months of shelf life remaining at listing. The Returns Policy sets out the returns rules for these categories.
5. Reporting
If you see a listing that breaks these rules, report it in the app or email support@swipswxp.com. We review reports and act in line with section 3 and the Community Guidelines.
